Contract disputes
Another party whom you do business with may claim you have not fulfilled your obligations or you may find that you need to make a claim against somebody whom you do business with for letting you down. We can assist in relation to such claims and we aim to try to narrow the issues in the dispute as early as possible in order to bring about a mutual agreement without the necessity for court proceedings. If proceedings are necessary, we have experience in all courts and can enforce and/or defend contractual duties and obligations.
Shareholder/director or partnership disputes
We can advise you in relation to a dispute with a co-worker if you are a director or in a partnership. In the event that you are a shareholder of a company, you may also have rights which you wish to enforce to protect your interest, which we can advise you on. We have acted in relation to similar disputes which have taken place in the Supreme Court of NSW arising out of partnership agreements and where fellow directors need to bring their relationship to an end. We will endeavour to provide you with a clear statement of your duties and obligations as a partner or director at the outset. We can also obtain assistance at an early stage, if necessary, from Counsel for complicated disputes.
