A Concerns Notice is something that only exists in Defamation Law. Rather than somebody having to file Court proceedings, instead what you do is we draft this Notice and it allows you to write to the person who has defamed you and it gives them an opportunity to apologise to you and to usually offer you some modest amount of compensation and always pay your legal costs. And provided the person responds and actually retracts the statement and gives you an apology, agrees to pay some reasonable amount of legal costs, they actually are then able to use that as a defence. So the point of it is that its trying to stop proceedings going to Court and so if somebody has effectively defamed you it gives them a very good ability to defend a claim once they make that offer to retract and apologise and so forth early on. So it’s a very good mechanism to allow people to resolve cases very quickly, very easily and without any Court proceedings being filed at all.
